0. Plain-English summary (not the contract, just the gist)

  • You buy a license to use the Software; you don't buy the Software itself.
  • The license is for you (one person), usable on your own computers.
  • It is a one-time license. No subscription, nothing recurs, nothing expires.
  • Don't share, resell, give away, or post your license key. Don't copy the Software for other people. Don't take it apart to copy how it works.
  • The music you make with it is 100% yours, royalty-free.
  • The Software is provided "as is". We work hard on it, but we can't promise it's perfect or fits every use.
  • AuraScope's Auto-Mixer feature is BETA and it changes your audio levels. Don't rely on it for final or irreplaceable work. Keep backups. (Section 5.)
  • The Software does not collect your data and your audio never leaves your computer. See the Privacy Policy.

The numbered sections below are the actual agreement.

1. Acceptance

By downloading, installing, activating, or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software and follow the refund process of the ForgeDSP store, subject to the Refund Policy posted there.

If you are agreeing on behalf of a company or organization, you confirm you are authorized to bind that organization to this EULA. You must be the age of majority in your jurisdiction (or have a parent or guardian's consent) to accept this EULA.

2. License grant (what you may do)

Subject to your payment and ongoing compliance with this EULA, ForgeDSP grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software.

This is a per-user license, licensed to you as one named user, not sold. You may install and use the Software on computers you own or personally control, up to 3 computers, provided it is not used by more than one person at a time beyond that limit.

Permitted uses include using the Software in your own music and audio production work, personal or commercial (tracks you sell, mixing for clients). All audio and MIDI you create with the Software is yours, royalty-free.

This license covers the version you download and any updates we choose to provide for it (free within 1.x). It does not automatically include future paid major versions or separate products.

3. Restrictions (what you may not do)

You may not, and may not allow anyone else to:

  1. Redistribute or resell: copy, sell, rent, lease, lend, sublicense, distribute, publish, or otherwise make the Software available to any third party, free or paid.
  2. Share keys: share, publish, sell, or transfer your license key. Each license is for one user.
  3. Circumvent licensing: bypass, disable, or tamper with any license check, demo limitation, or copy protection, or use a key you did not lawfully obtain.
  4. Reverse engineer beyond your legal rights: decompile, disassemble, decrypt, or attempt to derive the source code, except to the limited extent applicable law expressly permits despite this restriction.
  5. Modify or create derivative works, except as allowed by law.
  6. Remove or alter copyright, trademark, or proprietary notices.
  7. Misuse the brand: use the "ForgeDSP", "Kick Alchemist", "Aurichord", "AuraScope", "SubForge", or "PitchForge" names or logos in a way that implies endorsement or that you are the developer.
  8. Use the Software in violation of applicable law, including export-control and sanctions laws.

4. Ownership and intellectual property

The Software is licensed, not sold. ForgeDSP (and its licensors, including the makers of third-party components, see Section 11) retain all right, title, and interest in the Software. You receive only the license in Section 2. All rights not expressly granted are reserved.

The audio, MIDI, and music you create with the Software is yours. ForgeDSP claims no ownership of your music, projects, or recordings.

5. AuraScope Auto-Mixer: BETA feature disclaimer

AuraScope includes an Auto-Mixer feature clearly labelled BETA. Unlike the rest of the suite, the Auto-Mixer changes your audio: it adjusts track gain. By using it you acknowledge that it is experimental, may produce unexpected level changes, is used at your own risk on important or irreplaceable projects, is not a substitute for your own judgment, and that you are responsible for backups and for reviewing changes before committing. To the maximum extent permitted by law, ForgeDSP has no liability for results arising from the Auto-Mixer beta. This section applies only to AuraScope; no other ForgeDSP product alters your audio levels automatically.

6. Updates and changes

We may provide updates, bug fixes, and new features, but are not obligated to provide any update, support, or maintenance. We may change, suspend, or discontinue any feature at any time, with reasonable notice of material changes where practical.

7. License verification and demo mode

The Software includes a demo mode and unlocks with a license key (format FDSP1-...). Verification is performed entirely offline on your computer using a cryptographic signature check. No activation server, no account, and no network call is required or made for licensing. Demo limitations are enforced locally. See the Privacy Policy for the full data story (short version: there is none).

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. FORGEDSP DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.

ForgeDSP does not warrant that the Software will be uninterrupted, error-free, or compatible with your specific host, hardware, or operating system. Measurement and analysis readouts (spectrum, LUFS, true peak, stereo, dynamics, key detection, and similar) are provided for guidance and may differ from other tools; do not treat them as certified reference measurements for broadcast or delivery compliance.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. You may have statutory rights this section does not override.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: FORGEDSP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, AUDIO, PROJECTS, GOODWILL, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. FORGEDSP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $10.

These limits apply to all theories of liability. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in this EULA limits liability that cannot lawfully be limited.

10. Termination

This license lasts until terminated. It terminates automatically if you breach this EULA. ForgeDSP may also terminate or suspend your license if your purchase is reversed, refunded, charged back, or fraudulent. On termination you must stop using and delete all copies of the Software. If you obtained a refund, your license ends. Sections that by nature survive (ownership, disclaimers, limitations, governing law, general terms) survive termination.

11. Third-party components

The Software is built using third-party components, including the JUCE framework (used under the JUCE license) and the Monocypher cryptographic library (used under its public-domain CC0 / BSD-2-Clause terms). The applicable license notices for these components are provided with the Software.

12. Governing law and dispute resolution

This EULA is governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. You and ForgeDSP agree to the non-exclusive jurisdiction of the state and federal courts located in Alachua County, Florida for any dispute that is not resolved informally. Before starting a formal claim, you agree to first email us at transmissionrecieved@gmail.com and give us 30 days to resolve the matter; either party may still bring an individual claim in small-claims court. If you are a consumer resident in the United Kingdom, Canada, or Australia, this section does not remove the mandatory protections of your local consumer law or your right to bring proceedings in the courts of your home country, and those mandatory rights control to the extent they conflict with this section.

13. General

  • Entire agreement: this EULA (with the Privacy Policy) is the entire agreement about the Software and supersedes prior understandings.
  • Severability: if any part is held unenforceable, the rest stays in effect.
  • No waiver: failure to enforce a term is not a waiver of it.
  • Assignment: you may not assign this EULA; ForgeDSP may (e.g. business sale).
  • Changes: we may update this EULA for future versions; the version that applied when you installed continues to govern that install unless you accept a newer one.
